Trainers4me Terms of Service

ACCEPTANCE OF TERMS OF SERVICE AGREEMENT.
PLEASE READ THESE TERMS OF SERVICE (“TERMS”) CAREFULLY BEFORE USING THE WEBSITE AND ITS SERVICES.

Trainers4me Ltd (referred to as “Trainers4me”, “we”, “us” or “our”) provides an online platform trainers4me.com for people who want to enjoy a specific sport, improve within that sport and stay active. We connect our Members with professional trainers and sports instructors.
These Terms contain all of the terms and conditions between Trainers4me and you, whether you are a registered Trainer, a Member or any other user of our website.
Use of our website and our services indicates your agreement with these Terms (specifically with this "Agreement"). If you object to anything in this Agreement, including the Trainers4me Privacy Policy (http://trainers4me.com/Privacy-Policy/), do not use our website or the services provided by Trainers4me.

We are not providers of sports lessons, we only connect our Members with professional trainers and sports instructors.

This Website is provided solely to assist customers in gathering information, posting opinions of related issues and engaging in interactive purposes.

1.  MEMBER SERVICES

If you choose to sign up to our services, then you become a member ("Members and Trainers") of Trainers4me for the duration of your membership with us. This Agreement, together with the terms of your registration agreement, will govern your relationship with us and your use of our services during the duration of your membership.

2. CHANGES TO TERMS

These Terms, including the Privacy Policy, are subject to change by Trainers4me at any time. We will notify you about significant changes in these Terms by sending a notice to the e-mail address registered in your account, or by placing a prominent notice on our website, so that you can choose whether to continue using our services. Significant changes will go into effect no less than 30 days after we notify you. Any use of the site or the services by you after the effective date of any changes will constitute your acceptance of such changes. In addition, by accessing the website or becoming a member (if applicable), you consent to have this agreement provided to you in electronic form.

3. ELIGIBILITY

The website and services are intended solely for persons who are 18 or older. Any access to or use of the website or services by anyone under 18 is prohibited. By accessing or using the website or services, or by registering as a Member or Trainer, you represent and warrant that you are 18 or older.

4. SOCIAL NETWORKING SERVICES

By granting Trainers4me access to any social network accounts (Facebook, Google+ or any other), you understand that Trainers4me will access, make available and store (if applicable) any text, graphics, images, music, software, audio, video, information or other materials that you have provided to and stored within your social network account so that it is available on and through the website and services via your Trainers4me account, unless otherwise specified in these Terms. Depending on the social network accounts you choose, and subject to the privacy settings that you have set in such social network accounts, personally identifiable information that you post to your social network accounts will be available on and through your Trainers4me account on the website and services. Please note that if a social network account or associated service becomes unavailable on Trainers4me or access to such social network account is terminated by the third party service provider, then the social network content will no longer be available on and through the Trainers4me website and services.

Please note that your relationship with the third party service providers associated with your social network accounts is governed solely by your agreement(s) with such third party service providers.

5. RESPONSIBILITY OF COMMUNITY MEMBERS AND OUR WEBSITE

As a Member, Trainer or any other guest of our website, you must be aware that:

• Each Trainers4me guest, Member or Trainer can write comments, review Trainers and post other content on our website or through other Trainers4me online channels. We prohibit any insulting or hostile talk about a third party.
• In the event that someone publishes controversial content or links to such content (political, pornographic etc.) on the Trainers4me website, or our other online channels, such content or link will be immediately removed. If we are aware that such content has been published, we retain the right to remove it from the Trainers4me website or any other online channels of our website without warning.
• We reserve the right to delete any content or your account at any time without giving any reason.

6. OWNERSHIP

The website, services, and website content are protected by the copyright and trademark. You acknowledge and agree that the website, services and website content (including all associated intellectual property rights) are the exclusive property of Trainers4me. You will not remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the website, services, or website content.

7. MEMBER CONTENT

You acknowledge and agree that you are solely responsible for all the content that you make available through Trainers4me.com website and services.

8. TAXES

All Trainers4me members understand and agree that they are solely responsible for determining your applicable tax reporting requirements in consultation with your tax advisors.

9. CANCELLATION POLICY

We understand that sometimes circumstances arise that force a Member to cancel an already booked lesson. The cancellation is to be done following the ‘Cancelation Policy’, as specified in each Trainer’s profile. The Trainers4me website allows each Trainer to choose between either: No Cancellation Policy, Standard Cancellation Policy and Customised Cancellation Policy. 10. MINIMUM QUALITY STANDARDS

You acknowledge and agree that you are solely responsible for all sports in your account.
If you are a Trainer at Trainers4me, and you make yourself available as a trainer for a particular sport, you are liable to each Member that hired you for the lesson. The minimum standard you need to ensure is health and safety of the Member.

11. SERVICE FEES

The system is free of charge for registration and use.
Trainers will be charged with a service fee of the total amount received for their already paid for and completed lessons. Service fees of the total amount received will cover the bank charges, as well as the marketing and editing database costs. 12. PRIVACY

Trainers4me will only use the information you provide on the website in accordance with our Privacy Policy. For more information, see our full Privacy Policy.

13. LINKS TO EXTERNAL SITES

Links from the website to external sites (including external sites that are framed by Trainers4me) or inclusion of advertisements do not constitute an endorsement by Trainers4me of such sites or the content, products, advertising and other materials presented on such sites or of the products and services that are the subject of such advertisements, but are for users' reference and convenience. Users access them at their own risk. It is the responsibility of the user to evaluate the content and usefulness of the information obtained from other sites. Trainers4me does not control such sites, and is not responsible for their content. Just because Trainers4me has hyperlinks to such sites does not mean that Trainers4me endorses any of the material on such sites, or has any association with their operators. Users further acknowledge that the use of any site controlled, owned or operated by third parties is governed by the terms and conditions of use for those sites, and not by Trainers4me Terms and Privacy Policy. Trainers4me expressly disclaims any liability derived from the use and/or viewing of links that may appear on other websites.

15. MOBILE SERVICES

Our services may include certain services that are available via a mobile device, including (i) the ability to upload content to the service via a mobile device, (ii) the ability to browse the service and the website from a mobile device (iii) the ability to access certain features through an application downloaded and installed on a mobile device. Based on the extent you access our services through a mobile device, your wireless service carrier’s standard charges, data rates and other fees may apply.

16. OUR RESPONSIBILITY TOWARDS RESERVED LESSONS

Trainers4me allows our Members to find one of our Trainers for coaching lessons through our website. Before booking a Trainer, a Member has several options to verify the sporting experience of the selected trainer.
Trainers4me is not liable in any way for the satisfaction of a Trainer or a Member. Trainers4me is not responsible for any damage incurred before, during or after completion of the lesson.
Trainers4me does not verify the quality of the Trainer or the results upon completion of the lesson.
Trainers4me does not verify any additional costs and is not liable for any additional costs incurred. Trainers4me is not responsible for the cancellation of the booked lessons due to bad weather.
